The Global Picture on Period Leave
Japan introduced menstrual leave in 1947. Spain became the first European country to legislate paid period leave in 2023, offering 3 days per month for women with debilitating periods. Indonesia, South Korea, Taiwan, and Zambia all have some form of menstrual leave provision. The UK, US, and most of Europe do not, yet.
Current Rights in the UK and EU
In the UK, there is no statutory right to period leave. However, menstrual conditions like endometriosis and PMDD can qualify as disabilities under the Equality Act 2010 if they have a long-term, substantial adverse effect on daily activities. This means employers may have a duty to make reasonable adjustments, including flexible working, remote work options, or additional sick leave provisions, for qualifying conditions.
How to Approach Your Employer
You are never obligated to disclose menstrual health conditions to your employer. If you choose to, frame it in terms of a diagnosed medical condition (endometriosis, PMDD, fibroids) rather than "bad periods." Request reasonable adjustments in writing. If you are penalised for menstrual-related absence, this may constitute disability discrimination in jurisdictions where it qualifies as a disability.
The Argument for Period Leave
Opponents argue period leave reinforces gender stereotypes in the workplace. Proponents argue it acknowledges a real physiological reality and reduces the penalty women currently pay (sick leave deductions, performance management) for a natural bodily process. The debate is less about the leave itself and more about the social recognition it represents: that menstrual health is a legitimate workplace issue.
